CONSIDERATIONS ON THE PRIVACY POLICY OF WHATSAPP IN BUSINESS ENVIRONMENTS

BACKGROUND

On January 4, 2021, WhatsApp LLC, a Facebook company, made an update to its privacy policy [1] that modifies the conditions of personal data of users that are shared between Facebook companies, about which many news stories have been spread that have caused distrust among some groups of users of the tool.
This document is a guide to clarify the scope of these new policies along with the implications for Facebook providers such as Calltech SA and private companies who use this platform to communicate with end users, suppliers or customers.

CONVERSATIONS FROM CHAT

The new data privacy policy does NOT modify the confidential treatment of personal messages (chat, voice notes, video calls and attachments), which guarantees that WhatsApp does not see or monitor conversations between people or businesses since said personal messages are end-to-end encrypted as detailed in the WhatsApp service security article [2].

ABOUT DATA PRIVACY ON WHATSAPP FOR BUSINESS

The new privacy policy informs the following aspects regarding the use, access, processing and storage of personal messages:
of users when they interact with companies on WhatsApp [1].
• WhatsApp requires all companies linked to the WhatsApp for Business program to act in accordance with applicable laws when
share any information with Facebook companies.
• WhatsApp suggests that the user consult the privacy policy of each company with whom they share messages to find out
how it is sent, stored, read, managed or processed by the company or by a third party.
Faced with this, Calltech SA as a Facebook solutions provider has a privacy and data protection policy in accordance with
Law 1581 of 2012 of the Republic of Colombia and recommends that end customers review and publish their own privacy policies that mention the transfer and transmission of personal data of end users.
• WhatsApp informs all users when a company enrolled in the WhatsApp for Business program processes, stores or manages personal messages on Facebook services [6].

Calltech SA does not use, manage, process or store personal WhatsApp messages for businesses on Facebook hosting services.
