CONSIDERATIONS ON WHATSAPP'S PRIVACY POLICY IN BUSINESS ENVIRONMENTS
BACKGROUND
On January 4, 2021, WhatsApp LLC, a Facebook company, updated its privacy policy [1] that modifies the conditions of users’ personal data that is shared between Facebook companies about which many news articles have disseminated, causing distrust among some groups of users of that tool. This document is a guide to clarify the scope of these new policies along with the implications for Facebook providers such as Calltech S.A. and private companies who use this platform to communicate with end users, suppliers, or customers.
CHAT CONVERSATIONS
The new data privacy policy DOES NOT modify the confidential processing of personal messages (chat, voice notes, video calls and attachments), which guarantees that WhatsApp does not view or monitor conversations between people or businesses given that said personal messages are end-to-end encrypted as detailed in the WhatsApp service security article [2].

ABOUT THE PRIVACY OF DATA IN WHATSAPP FOR BUSINESS
The new privacy policy informs on the following aspects regarding the use, access, processing, and storage of users’ personal messages when they interact with companies through WhatsApp [1].
- WhatsApp requires all companies linked to WhatsApp for Business to comply with applicable local laws governing the sharing of any information with Facebook companies.
- WhatsApp suggests that users consult the privacy policy of each company with whom they message to find out how their data is sent, stored, read, managed, or processed by the company or by third parties. Given this, as a Facebook solutions provider, Calltech S.A has a privacy and data protection policy in accordance with Law 1581 of 2012 of the Republic of Colombia and recommends that end customers review and publish their own privacy policies that explain the transfer and transmission of end-users’ personal data.
WhatsApp informs all users of when a company registered in the WhatsApp for Business program processes, stores, or manages personal messages in Facebook services [6].
Calltech S.A. does not use, manage, process, or store personal WhatsApp for Business messages on Facebook hosting services.
